serious psychological consequences.<sup><a href=\"https:\/\/www.khmertimeskh.com\/501847531\/online-scams-cost-cambodians-45-million-in-2025-as-official-warns-of-suicide-risk\/\" target=\"_blank\" rel=\"noopener\" style=\"text-decoration: none; color: #1e4a8b;\">[1]<\/a><\/sup> As a response, Cambodia has introduced a new law on technology-enabled fraud, significantly expanding enforcement powers and increasing legal exposure for both individuals and businesses operating in digital spaces.<\/p>\n<\/div>\n\n<div class=\"section\" style=\"margin-bottom: 2rem;\">\n<p style=\"text-align: justify; margin-bottom: 1rem; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">At its core, the law targets deception carried out through technology. This includes the use of online platforms, social media, and digital payment systems to obtain money, property, services, or other benefits through dishonest means. However, the law goes further than simply criminalizing fraud itself\u2014it also captures the wider ecosystem that enables it.<\/p>\n\n<p style=\"text-align: justify; margin-bottom: 1rem; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">For example, the following activities are now explicitly covered:<\/p>\n\n<ul style=\"margin-left: 1.5rem; margin-bottom: 1.5rem; list-style-position: outside;\">\n \t<li style=\"margin-bottom: 0.75rem; text-align: justify; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">Organizing or leading fraud networks or &#8220;fraud centers&#8221;;<\/li>\n \t<li style=\"margin-bottom: 0.75rem; text-align: justify; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">Recruiting or training individuals to participate in fraud; and<\/li>\n \t<li style=\"margin-bottom: 0.75rem; text-align: justify; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">Collecting or using personal data (such as IDs or passports) for fraudulent purposes.<\/li>\n<\/ul>\n\n<p style=\"text-align: justify; margin-bottom: 0; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">This broader scope means that early-stage or indirect involvement can still attract serious legal consequences.<\/p>\n<\/div>\n\n<div class=\"section\" style=\"margin-bottom: 2rem;\">\n<p style=\"text-align: justify; margin-bottom: 1rem; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">Another key development is the expansion of liability beyond individuals. Businesses can now be held criminally responsible if fraud is committed through their systems or platforms or for their benefit. A company does not need to be physically present in Cambodia to be affected. The law may apply if:<\/p>\n<div class=\"value-item\" style=\"background: #fff; padding: 1rem; margin-bottom: 0.75rem; border-radius: 6px; border-left: 4px solid #2c6eb4;\">\n<p style=\"margin: 0; text-align: justify; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\"><strong>A.<\/strong> A Cambodian user is involved (as a victim or perpetrator);<\/p>\n<\/div>\n<div class=\"value-item\" style=\"background: #fff; padding: 1rem; margin-bottom: 0.75rem; border-radius: 6px; border-left: 4px solid #2c6eb4;\">\n<p style=\"margin: 0; text-align: justify; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\"><strong>B.<\/strong> Funds move into or out of Cambodia; or<\/p>\n<\/div>\n<div class=\"value-item\" style=\"background: #fff; padding: 1rem; margin-bottom: 0.75rem; border-radius: 6px; border-left: 4px solid #2c6eb4;\">\n<p style=\"margin: 0; text-align: justify; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\"><strong>C.<\/strong> Cambodian banking or financial infrastructure is used.<\/p>\n<\/div>\n<p style=\"margin-top: 1rem; margin-bottom: 0; text-align: justify; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">In practical terms, this means that foreign businesses\u2014such as online platforms, payment providers, and service-based companies\u2014can fall within the scope of Cambodian law simply through their digital footprint.<\/p>\n<\/div>\n<\/div>\n\n<div class=\"section\" style=\"margin-bottom: 2rem;\">\n<p style=\"text-align: justify; margin-bottom: 1rem; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">From an operational perspective, the implications are significant. Companies that host user-generated content or facilitate transactions must consider whether their systems could be used for fraudulent purposes. Weak monitoring, poor verification processes, or gaps in internal controls may expose the business to scrutiny\u2014even where there is no intentional wrongdoing.<\/p>\n\n<p style=\"text-align: justify; margin-bottom: 1rem; text-justify: inter-word; word-spacing: normal; letter-spacing: normal;\">Data handling is also becoming a high-risk area. Businesses that collect and store customer information must ensure that such data cannot be misused to create fraudulent accounts or schemes. In addition, authorities now have the power to act quickly, including freezing suspicious transactions for up to 48 hours and ordering the seizure of assets linked to fraud.
